Colorado Supreme Court Vacates $300,000 Restitution Order
Client was involved in an auto accident and was charged with vehicular homicide. Client received a reduced plea and stipulated to $4,900 in restitution. The District Court later imposed an additional $300,000 in restitution against our client. M. Colin Bresee and Peter Albani appealed the $300,000 increase in restitution. The Colorado Court of Appeals reversed the District Court and ordered that the $4500 stipulation was the final restitution order. The Colorado Supreme Court agreed to hear the case. The Colorado Supreme Court agreed with the Court of Appeals and ruled that the $300,000 increase in restitution violated the law. Mr. Albani has successfully argued numerous appeals in Colorado.
Child Abuse Resulting In Death - Not Guilty
Client charged with Child Abuse Resulting in Death following a fatal rollover of an ATV. The child was not wearing a helmet. Charles Fife and Peter Albani represented Client at jury trial. Attorneys argued that Colorado did not require a helmet law in this situation. The jury agreed and the Client was found not guilty on all charges. Mr. Albani has successfully defended over 30 murder and homicide related cases.
DUI Case - Not Guilty Verdict
Client was parked on the side of the road on a cold winter night. Client’s keys were in the ignition and the heater was on. Client was asleep behind the wheel when the officers approached and arrested him. Jeff Cuneo and Peter Albani argued at trial that the Client never intended to drive and that he was waiting for his girlfriend to pick him up and drive him home. The jury agreed and the Client was found not guilty of all charges. Mr. Albani has successfully defended hundreds of DUI cases including vehicular assault and vehicular homicide.
